General Terms and Conditions
Last updated: 15.07.2026
1. Scope
These General Terms and Conditions, hereinafter "GTC", apply to all orders of physical products placed via the online shop at www.owletcare.ch, hereinafter "online shop".
The operator of the online shop and contracting party for all orders is:
LUNA Swiss GmbH
Webereistrasse 68
8134 Adliswil
Switzerland
Phone: +41 43 928 37 58
E-Mail: owlet@luna-swiss.ch
Hereinafter, LUNA Swiss GmbH is referred to as "LUNA Swiss", "we" or "us". Persons who order products via the online shop are referred to as "customer", "client" or "you".
These GTC apply regardless of whether you order as a consumer or within the scope of a business activity. Mandatory statutory provisions for the protection of consumers remain reserved.
Deviating or supplementary terms and conditions of the customer shall only be recognized if we have expressly agreed to them in text form. Individual agreements between LUNA Swiss and the customer take precedence over these GTC.
In addition to these GTC, the shipping terms, return and withdrawal policies, warranty provisions, and the privacy policy published in the online shop apply. The versions valid at the time of the order form part of the contract, insofar as they are applicable to the respective order.
2. Product Information
Product displays in the online shop are for information purposes and do not generally constitute a legally binding offer.
We strive to present product descriptions, illustrations, prices, availability, and other information completely and correctly. Minor deviations between the representations in the online shop and the delivered product, particularly regarding color, packaging, or design, may occur due to technical displays or product adjustments and do not constitute a defect, provided the essential properties and function of the product are not impaired.
Decisive for the properties, intended purpose, and correct use of a product are the respective product description, instructions for use, safety instructions, and any regulatory product information.
LUNA Swiss reserves the right to adjust the range, product descriptions, and other content of the online shop at any time.
3. Order and Conclusion of Contract
You can initially place the desired products into the shopping cart without obligation. Before submitting the order, you can check your details, correct them, or cancel the order.
By clicking the button to complete the order with an obligation to pay, you submit a binding offer to purchase the products contained in the shopping cart. At the same time, you confirm that the information provided by you is complete and correct and that you agree to these GTC as well as the other conditions included in the ordering process.
After receipt of the order, you will receive an automatic order confirmation by email. This order confirmation merely documents that your order has been received by us. It does not yet constitute an acceptance of your offer.
The purchase contract is concluded as soon as we:
a) expressly accept the order by email,
b) ship the ordered products, or
c) send you a shipping confirmation.
The earliest point in time that occurs is decisive.
We are entitled to reject an order in whole or in part for objective reasons. Such reasons may exist in particular in cases of:
-
lack of product availability
-
obviously incorrect price or product information
-
failed or unauthorized payment
-
suspicion of abuse or fraud
-
unusual order quantities
-
violations of these GTC
-
inability to deliver to the specified address
If a payment for a rejected or cancelled order has already been charged, the corresponding amount will be refunded via the originally used payment method.
The commercial resale of our products requires our prior written consent.
4. Minimum Age and Customer Account
Orders may only be placed by persons who are at least 18 years of age and legally competent.
You may, if offered in the online shop, open a customer account. During registration, you must provide complete and correct information and update it in the event of changes.
The access data for your customer account must be treated confidentially and must not be passed on to unauthorized third parties. Please notify us immediately if you suspect that your customer account has been used without authorization.
The customer account in the online shop is not identical to any user account for the Owlet app. For the Owlet app and associated digital services, separate terms of Owlet Baby Care Inc. or another specified provider may apply.
5. Availability
Products are generally only available while stocks last.
Information on availability as well as shipping and delivery times are non-binding estimates, unless expressly designated as binding.
Should it turn out after receipt of your order that an ordered product is not available or not available in the desired quantity, we will inform you as soon as possible.
In this case, we may:
-
reject the order for the unavailable product
-
offer an equivalent replacement product after consultation
-
execute the order partially
-
cancel the entire order if a partial delivery is not sensible
Already paid amounts for undelivered products will be refunded.
6. Prices
The prices stated in the online shop at the time of the order apply.
All prices are quoted in Swiss Francs and include the statutory Swiss VAT. Where applicable, prices also include the advance recycling fee.
Additional costs, in particular shipping costs, are shown separately before the order is finalized.
LUNA Swiss may change prices at any time. Price changes do not affect contracts that have already been concluded.
In the case of obviously incorrect price information which, recognizable to the customer, is based on a technical, editorial, or other error, we are entitled to reject or cancel the affected order. Payments already made will be refunded in this case.
7. Payment
The available payment methods are displayed in the online shop and during the order process. We may adjust the offered payment methods or restrict them for individual orders at any time.
Unless otherwise stated in the order process, the invoice amount is due immediately upon completion of the order.
When using an external payment service provider, the business and privacy terms of the respective payment service provider may additionally apply.
You are responsible for ensuring that the provided payment information is correct and that you are authorized to use the chosen payment method.
If a payment is rejected, unauthorized, charged back, or not executed on time, we may reject the order, suspend shipment, or withdraw from the contract.
In the event of unjustified chargebacks or late payment, we may charge the actual and reasonable processing, banking, and collection costs. Further statutory claims remain reserved.
8. Delivery and Shipping
We deliver to the delivery address specified in the order process within the delivery area indicated in the online shop.
The respective applicable shipping costs, delivery times, shipping methods, and any free shipping thresholds are visible in our shipping terms as well as in the order process.
The indicated delivery times are non-binding estimates, unless a binding delivery date has been expressly agreed upon.
Partial deliveries are permitted insofar as they are reasonable for the customer. A partial delivery initiated by us does not result in additional shipping costs for the customer.
Delivery delays can arise, in particular, due to high demand, supply shortages, delays at manufacturers or transport companies, as well as events outside our control. We will inform you of significant delays of which we are aware.
If an order cannot be delivered due to an incorrect or incomplete delivery address, refusal of acceptance, or other circumstances for which the customer is responsible, we may invoice the actual costs incurred for shipping, return transport, and re-shipment.
Mandatory rights in the event of default in delivery remain reserved.
9. Retention of Title
The delivered goods remain the property of LUNA Swiss GmbH until full payment has been made.
If necessary, we are entitled to have the retention of title entered in the responsible retention of title register at the customer's expense.
10. Transport Damage and Incorrect Deliveries
If products are delivered with obvious transport damage, we ask you to report the damage to the delivery service as soon as possible and to document it with suitable photos.
Please also contact us as soon as possible, stating your order number and a description of the damage.
If you receive an incorrect product or the delivery is incomplete, we also ask for a prompt notification.
Failure to report to the delivery service does not affect mandatory claims for defective delivery. However, a prompt report helps us to assert our claims against the transport company or a transport insurance provider.
11. Returns and Voluntary Right of Withdrawal
Swiss law does not provide for a general statutory right of withdrawal for standard online purchases.
To the extent that LUNA Swiss grants a voluntary right of return or withdrawal, only the return and withdrawal conditions published in the online shop at the time of the order apply.
These regulate in particular:
-
the applicable return or withdrawal period
-
the requirements for a return
-
possible exclusions for hygienic, health, or product-specific reasons
-
the condition and completeness of the products to be returned
-
the bearing of return costs
-
the procedure for refunds
-
the return address
The voluntary right of return or withdrawal exists independently of claims for defective or incorrectly delivered goods.
12. Inspection of Goods and Notice of Defects
Please inspect the delivered products upon receipt for correctness, completeness, and recognizable damage.
Obvious defects, incorrect deliveries, and transport damage must be reported to us as promptly as possible after receipt. Defects that were not recognizable during a standard inspection must be reported to us as promptly as possible after their discovery.
The notification should contain a description of the defect, the order number, and, if possible, photos or videos.
A late notification can make it difficult to examine the defect and assert claims against manufacturers or transport companies. Mandatory statutory rights remain reserved.
13. Warranty
LUNA Swiss warrants that the delivered products are free from defects at the time of the transfer of risk that significantly impair their value or suitability for the intended use, and that they possess the expressly warranted characteristics.
The warranty period for new electrical products is two years from the date of delivery.
In the event of a justified warranty claim, LUNA Swiss is initially entitled, at its own discretion, to:
a) remedy the defect,
b) replace the defective product, or
c) offer another appropriate solution.
LUNA Swiss may require that the complained-about product be sent in for inspection or presented at a designated location.
If the repair or replacement delivery fails within a reasonable period or is unreasonable, the customer may demand an appropriate price reduction or the rescission of the purchase contract in the event of a significant defect.
Excluded from the warranty are, in particular, damage and functional impairments caused by:
-
improper or inappropriate use
-
disregard of the instructions for use or safety instructions
-
normal wear and tear
-
falls, impacts, liquid damage, or other external influences
-
unauthorized repairs, modifications, or interventions
-
use of unsuitable accessories or spare parts
-
improper storage, cleaning, or maintenance
-
use outside the specified technical requirements
In the event of a confirmed warranty case, LUNA Swiss will cover the reasonable costs of the necessary return shipment. Products must not be sent to us carriage forward without prior contact.
Mandatory statutory claims remain reserved.
14. Additional Warranties
For certain products, an additional voluntary manufacturer or dealer warranty may apply.
Information regarding such a warranty, in particular duration, requirements, scope of services, exclusions, and procedures, can be found in the respective warranty provisions or the relevant product description.
A voluntary warranty exists in addition to the warranty rights regulated in these GTC and does not limit them.
15. Use of Products
Owlet products must be used exclusively in accordance with their respective intended purpose, product description, instructions for use, and associated safety instructions.
The products do not replace the personal supervision of a baby or child. Parents and caregivers remain responsible for appropriate supervision and care at all times.
Product displays, app notifications, measurements, and alerts do not replace professional medical examination, diagnosis, or treatment. In case of health concerns or a suspected medical emergency, a medical professional or the responsible emergency service must be contacted immediately.
The regulatory classification and medical purpose can vary depending on the product. The information for the respective product and its instructions for use are decisive.
For the use of the Owlet app, user accounts, software, cloud services, and other digital features, additional terms of use and privacy policies of the respective provider may apply.
16. Liability
LUNA Swiss is liable for damages caused by intentional or grossly negligent behavior of LUNA Swiss.
To the extent permitted by law, liability for slight negligence as well as for indirect and consequential damages is excluded. This includes, in particular, loss of profit, loss of revenue, loss of data, loss of use, and reputational damage.
Liability for auxiliary persons is excluded to the extent permitted by law.
The aforementioned exclusions and limitations of liability do not apply:
-
in the event of injury to life, body, or health
-
in the event of intentional or grossly negligent behavior
-
in the event of fraudulent concealment of a defect
-
in the event of expressly assumed warranty promises
-
insofar as the Swiss Product Liability Act or other mandatory statutory provisions are applicable
The personal supervision and care of a child remains the responsibility of the parents or caregivers. LUNA Swiss is not liable for damages arising from use of the products contrary to the instructions for use, intended purpose, or safety instructions.
17. Events Outside Our Control
LUNA Swiss is not liable for the non-fulfillment or delayed fulfillment of obligations insofar as this is due to events outside its reasonable control.
This includes, in particular, natural disasters, epidemics, pandemics, war, terrorist attacks, official measures, strikes, failures of communication or transport networks, energy outages, as well as significant supply or production disruptions at manufacturers and suppliers.
We will inform the affected customers of significant restrictions of which we are aware and will endeavor to keep the impacts as low as possible.
If the impediment to performance lasts for an extended period, both parties may withdraw from the contract regarding the services not yet rendered. Payments already received for services not rendered shall be refunded.
18. Data Protection
Personal data will be processed in accordance with applicable data protection law and our privacy policy published in the online shop.
The privacy policy provides information in particular on the type, scope, and purpose of data processing, service providers used, any data transfers abroad, and the rights of the data subjects.
Separate privacy policies may apply to the use of the Owlet app and other services provided by Owlet Baby Care Inc.
19. Copyright and Other Intellectual Property Rights
The contents of the online shop, in particular texts, images, graphics, videos, logos, product presentations, and designs, are protected by copyright or other intellectual property rights.
They may not be reproduced, edited, distributed, published, or used for commercial purposes without the prior consent of the respective rights holder.
The brands and product labels of Owlet are the property of the respective rights holders.
20. Changes to these GTC
LUNA Swiss may change these GTC at any time for future orders.
For an order, the version of the GTC that was published in the online shop at the time the order was placed and included in the ordering process applies.
Subsequent changes to these GTC have no influence on already concluded purchase contracts, unless otherwise expressly agreed or if a change is required due to mandatory legal requirements.
21. Severability Clause
Should any provision of these GTC be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
The applicable statutory provisions shall apply in place of the invalid or unenforceable provision.
22. Applicable Law and Jurisdiction
Swiss law applies to these GTC, the purchase contracts concluded under them, and related disputes.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
The mandatory statutory places of jurisdiction apply to actions brought by consumers.
Otherwise, to the extent permitted by law, the registered office of LUNA Swiss GmbH is the exclusive place of jurisdiction.
